The Regulatory Reform (Fire Safety) Order 2005 came into effect on 01 October 2006. This order relates to fire risk management in all businesses. It places the sole responsibility onto employers to ensure that a Fire Risk Assessment is carried out on all premises.

Following the introduction of the new order, the safety of staff in the workplace is no longer confined to a valid fire certificate or routine inspections. Fire Certificates will cease to be valid.

The new legislation places the responsibility upon employers (and other people) to ensure the Health, Safety and Welfare of employees. All employers will be legally required to ensure the risk of fire to their employees is assessed. And, where there are 5 or more employees, the Fire Risk Assessment must be formally and properly documented.

Remember - the responsibility to carry out these assessments rests with the employer - It will not be done by the Fire Service, but as the enforcing authority - they may inspect to ensure compliance.

Failure to comply with the regulations can result in civil proceedings and where people are put at serious risk from fire, criminal proceedings can result and heavy fines or imprisonment imposed.
